DrumPen Terms of Service

Version: 2026-10-22 · Effective: October 22, 2026

If the Korean version and this translation differ, the Korean version prevails.

1. Purpose

These Terms set out the conditions and procedures for using DrumPen (drumpen.com, the "Service"), provided by ETS Corporation (이티에스 주식회사, the "Company"), and the rights and obligations of the Company and users.

2. Definitions

  1. A "user" is anyone who uses the Service under these Terms, including people who use it without signing in.
  2. A "member" is a user who has agreed to these Terms and the Privacy Policy and created an account.
  3. A "song" is drum chart data a user creates with the Service (notes, song structure, lyrics, memos, settings) and files exported from it (PDF, PNG, WAV, MIDI, .drumpen).

3. Posting and changing these Terms

  1. The Company posts these Terms where they are easy to find in the Service.
  2. The Company may change these Terms within the limits of applicable law. Changes, with the effective date and the reason, will be announced at least 7 days in advance. Changes unfavorable to members will be announced in the Service and by email at least 30 days in advance.
  3. If you don't agree to the changes, you may delete your account. If the notice clearly stated that not objecting by the effective date counts as agreement and you do not object, you will be deemed to have agreed.

4. Signing up

  1. You must be 14 or older to sign up.
  2. You can sign up with an email address and password or with a Google account. Email sign-up is complete once you click the link in the confirmation email.
  3. You must not sign up using someone else's information. If this is confirmed, the Company may suspend or delete the account.

5. Your account

  1. You are responsible for your account and password and must not let others use them.
  2. On shared computers, turn off "Stay signed in" and sign out when you're done.
  3. If you discover unauthorized use of your account, change your password right away and let the Company know.

6. What the Service provides

  1. The Service lets you create, play back, print, and export drum charts, and lets members save songs on our servers to use them on multiple devices.
  2. Editing, playback, and saving or opening .drumpen files are available without signing in. Exporting to PDF, PNG, WAV, or MIDI, printing, and cloud storage require signing in.
  3. The Service is currently in beta and free of charge.

7. Introducing paid services

  1. The Company may make some features paid or offer paid plans in the future.
  2. Before introducing paid services or making free features paid, the Company will announce the details, prices, and effective date in the Service and by email at least 30 days in advance.
  3. You will not be charged unless you sign up and pay yourself.
  4. Even after features become paid, members can still download songs they have already created as .drumpen files.

8. Changes to or suspension of the Service

  1. The Company may change or remove features to improve the Service, and will give advance notice of changes that significantly affect members.
  2. The Service may be temporarily unavailable due to maintenance, equipment failure, outages at third-party providers, natural disasters, and similar causes. Where this can be foreseen, the Company will give advance notice.
  3. If the Service is shut down, the Company will give 30 days' notice and let members download their songs during that time.

9. Rights to songs and content

  1. You own the songs you create. The Company processes your songs only as needed to provide the Service (storage, backup, display, and file conversion), and will not publish them or use them for other purposes without your permission.
  2. If you create songs based on others' works (music, lyrics, sheet music), you are responsible for copyright and other rights. Transcribe for personal practice or teaching within the limits of applicable law.
  3. The Service's software, design, logo, drum sounds, and similar materials belong to the Company or their respective rights holders. Drum sounds come from openly licensed (CC0) sources.

10. Prohibited conduct

You must not:

  1. Sign up with someone else's information or use someone else's account
  2. Access the Service in automated ways that overload it, hack it, or try to bypass its security
  3. Modify, copy, or redistribute the Service
  4. Infringe others' copyright or other rights
  5. Act against the law or public order

11. Restrictions on use

If a member violates section 10, the Company may restrict use in stages: a warning, temporary suspension, then account deletion. The Company will explain the reason and give the member a chance to respond beforehand; in urgent cases, the Company may restrict use first and notify the member right away.

12. Deleting your account and data

  1. Members can delete their account at any time from the account menu.
  2. When you request deletion, you are signed out on all devices right away and can no longer use the Service. You can cancel the request by signing in again within 7 days. After 7 days, your account and songs on our servers are permanently deleted and cannot be recovered.
  3. Before deleting your account, use "Download all my songs" to keep your songs.
  4. Songs in the trash are deleted automatically after 30 days.

13. Limitation of liability

  1. The Company works to provide the Service reliably. However, as a free beta service, it is not guaranteed to be error-free or fit for any particular purpose.
  2. The Company is not liable for damages caused by events without the Company's intent or negligence, such as natural disasters, a member's own fault, or outages at third-party providers.
  3. The Company is liable under applicable law for damages caused by the Company's intent or gross negligence.
  4. To guard against loss, we recommend also saving important songs as .drumpen files.

14. Notices

The Company notifies members by the email address they signed up with or by posting in the Service. Notices to many members at once may be given by posting in the Service for at least 7 days.

15. Governing law and disputes

  1. These Terms are governed by the laws of the Republic of Korea.
  2. Please contact support@drumpen.com first to resolve any dispute. If it cannot be resolved, it will be settled by the court with jurisdiction under the Korean Civil Procedure Act.
